The #Trump admin appealed. On Friday, a three-judge panel of the DC Circuit U.S. Court of Appeals sided with the government by a 2-1 vote.

"The District Court's order raises troubling questions about judicial control over core executive functions like the conduct of foreign policy & the prosecution of criminal offenses," Circuit Judge Gregory #Katsas wrote in a [bullshit] opinion.

U.S. District Judge James #Boasberg found in April that #Trump officials could face #criminal #contempt charges for willfully disregarding his March 15 order barring the #deportations to #ElSalvador of alleged #Venezuelan gang members under the 1798 #AlienEnemiesAct without the chance to challenge their removals.

appeared on the #MAGA radar in March after blocking the Trump admin’s invocation of the wartime 1798 #AlienEnemiesAct to indiscriminately deport men #Trump claimed were Tren de Aragua gang members to El Salvador. The administration ignored Boasberg’s #CourtOrder, & he asserted he found probable cause for #contempt on the admin’s part, although the DC Circuit Court has paused proceedings.

Friday’s swap was a remarkable development after #Trump did not follow a #CourtOrder — issued as the planes were in flight or preparing for takeoff — to halt & reverse most of the removals in a high-stakes early bid to claim #ExecutivePower & prove he was serious about ridding the country of illegal immigrants. The admin never provided a complete list of their identities, & told a series of courts it had no #power to force or even ask #ElSalvador to return them.

The newly-released messages reinforce claims by #whistleblower #ErezReuveni that #EmilBove played a key role in a decision by #Trump admin #immigration ofcls to turn scores of #Venezuelan immigrants over to #ElSalvador despite a US judge’s #CourtOrder not to do so.

The messages show increasing alarm among #DOJ lawyers that the admin had in fact defied court orders & that some ofcls…could face #sanctions for misleading courts.

At 6:44PM, Reuveni texted his supervisor, Flentje, referring to #EmilBove’s disparaging comment toward the judicial system. Flentje, his account continued, “acknowledged Bove’s comment with a joke referencing the possibility that either he or Reuveni could be fired, impliedly for reporting up their chain of command concerns that a #CourtOrder may have been violated.”

Judge Burroughs acted hours after #Harvard asked her to block the order on Thurs evening. In its request, part of an ongoing lawsuit, the #university also filed a new claim against the #Trump admin.

In court papers, Harvard accused the admin of trying to circumvent an earlier #CourtOrder that had blocked #DHS from banning international enrollment at Harvard. The university said Trump had violated the #law again by invoking his #ExecutivePower against the school when the agency’s efforts failed.

In an amended complaint filed Thurs, #Harvard called #Trump’s action an end-run around a previous #CourtOrder. Last month, a federal judge blocked #DHS from revoking #Harvard’s ability to host #InternationalStudents.
The filing attacks Trump’s legal justification for the action—a federal #law allowing him to block a “class of aliens”deemed detrimental to the nation’s interests. Targeting only those who are coming to the US to study at Harvard doesn’t qualify as a “class of aliens,” Harvard said.

This is specifically NOT about #KilmarAbregoGarcia. Rather a 19-year-old accused of being part of Tren de Aragua & sent to #CECOT under the #AlienEnemiesAct also in violation of a separate #CourtOrder.

The ever-growing market for #personal #data has been a boon for American spy agencies. The US #intelligence community is now buying up vast volumes of sensitive #information that would have previously required a #CourtOrder, essentially bypassing the #FourthAmendment. But the #SurveillanceState has encountered a problem: There’s simply too much data on sale from too many corporations & brokers.

So the government has a plan for a one-stop shop.
